Kier Considers THIS to be Preventative Maintenance:

According to Kier's own attorney, Byron Benevento of Snell & Wilmer (SLC),  "Kier Property Management did everything they were contractually obligated to do", with regards to maintaining the property's infrastructure.

Clearly, Mr Benevento is either:
  • Unfamiliar with which property I am referring to;   or -
  • He suffers from an extreme lack of comprehension of the English language;   or -
  • HE'S A DELUSIONAL, COMPULSIVE LIAR WHO NEEDS SOME SERIOUS HELP

Regardless...

According to paragraph 10-a of my contract with Kier, they were required to give special attention to, "Preventative Maintenance" at the building.... and a signed contract trumps a lying lawyer, any day of the week.

Part of what would normally be considered as a building's, “Infrastructure", would be the exterior drainage system of the building. Failing to ensure that this system is maintained in good working order, could result in damage to the property.

With regard to paragraph 10 (all sub-sections) of my contract with Kier... Please note that the following conditions are in no way acceptable to the owner, under ANY circumstance ...  EVER.

I  would like to know exactly what Kier defines as 
"Preventative Maintenance"

Because THIS isn't it
Because Kier failed to do ANY preventative maintenance at the building... 
rocks and other debris had clogged this 40 foot rain gutter downspout drain, causing
water to shoot out from the bottom, creating a small lake in the rear parking area
when it rained. The water would then seep through the building's foundation and
down into the basement.

Preventative Maintenance Huh?


Nope... I'm afraid this isn't it either





Kier's near compulsive disregard for other people and their complete and utter failure to uphold MOST of the terms and conditions of our contract, as required, caused these rain gutter downspouts to become clogged with numerous YEARS worth of trash, debris, rocks, broken glass, pigeon feces, toys and other objects that somehow made it up onto the roof and then down through nearly 45 feet of downspouts, resulting in....

FYI:  Duct Tape IS NOT Considered
"Preventative Maintenance"
Once again, because of Kier's failure to do ANY preventative maintenance here...
the water flowing out of this clogged downspout drain, would form a sheet of ice across
the pavement, creating a significant slip and fall hazard for the tenants in units: 10, 11, 12, and 14.

THIS IS HOW THE BROKEN DRAIN PIPE SHOULD HAVE 
BEEN ADDRESSED... NOT WITH DUCT TAPE.
This is the same rain gutter downspout that Kier attempted to repair with duct tape,
as shown in the video above, after I had it properly repaired.
